These Terms of Service ("Terms") are a binding agreement between you and SiyaRa Enterprise Limited, the company that operates Katha ("Katha", "we", "us", or "our") from Ontario, Canada. They govern your access to and use of our website and matchmaking services (the "Service"). Please read them carefully. Section 16 (Dispute Resolution) asks that most disputes be resolved by binding arbitration on an individual basis, and waives jury trials and class actions, to the extent the law where you live allows it. Nothing in these Terms takes away consumer protections that the law of your province, state, or country does not allow us to limit.
By creating an account or using the Service, you agree to these Terms and to our Privacy Policy, and you agree to receive notices from us electronically, at the email address on your account. If you do not agree, do not use the Service.
To use Katha you must be at least 18 years old, single and legally free to marry, and able to form a binding contract. By using the Service you represent that all of these are true, that you are not barred from using the Service under any applicable law, and that you have never been convicted of, or pleaded guilty or no contest to, an indictable offence or felony, a sexual offence, or a crime involving violence, fraud, or harassment.
Every profile is verified before it is shown to anyone. You must complete identity verification (Section 8) before you can see or contact other members. Until then, your account exists but is not visible.
You agree to provide accurate, current, and complete information and to keep it up to date. Your name, date of birth, and gender must be your own and must match your identity document; once your profile is verified they cannot be changed without contacting us. Your photos must be recent, unedited photographs of you. You are responsible for all activity under your account and for keeping your credentials confidential; notify us promptly of any unauthorised use. You may not create more than one account, create an account for anyone else without their authority, or transfer your account.
Families are welcome to help. A parent or relative may assist with a profile, but the profile must describe a real person who has agreed to be on Katha, who meets Section 1, and who is the person shown in the photos and the identity document. The account holder is responsible for everything done through the account.
Katha helps you discover and connect with potential matches using profile information and Vedic compatibility tools. We do not promise or guarantee that you will find a match, form a relationship, or marry, or that any match is compatible, honest, safe, or suitable. Compatibility scores, Kundli reports, and Guna Milan results are computed automatically from the birth details members provide; they are offered for cultural and informational purposes and are not advice, a prediction, or a guarantee of any outcome. Match suggestions are ranked automatically and do not reflect a judgement about you or anyone else.
Some features require a paid plan ("Premium"). Prices are shown at checkout in Canadian dollars unless stated otherwise, and applicable taxes are added at checkout. The 3-month, 6-month, and 1-year plans renew automatically at the end of each period at the then-current price, and your payment method is charged automatically, until you cancel. The Lifetime plan is a single one-time payment and never renews. The renewal terms are shown beside the button you press to subscribe, your receipt states the date and amount of your next charge, and your renewal date is shown on the Pricing page whenever you are signed in.
You can cancel at any time from the Settings page or the Stripe billing portal. When you cancel, you keep Premium until the end of the current period and are not charged again. Cancelling does not entitle you to a refund for the current period.
Premium starts the moment your payment succeeds, at your request. Except where the law where you live requires otherwise, payments are non-refundable. If you live somewhere that gives you a statutory right to cancel a digital service within a cooling-off period (for example, the United Kingdom), you may cancel within that period for a full refund unless you have already started using Premium, in which case, by asking us to start it immediately, you acknowledge that the right to cancel is lost to the extent the law permits; where the law does not permit that, your right remains.
We may change prices or what a plan includes on a going-forward basis. We will email you at least 30 days before a price change takes effect, and it will apply only from your next renewal. If you do not agree, cancel before the renewal.
You keep ownership of the photos, video, text, and other content you submit ("User Content"). You grant Katha a worldwide, non-exclusive, royalty-free licence to host, store, resize, display, and use your User Content as needed to operate, secure, and provide the Service, including showing your profile to other verified members according to your settings and our paywalls. This licence ends when you delete the content or your account, except for copies in routine backups (removed within 30 days) and content another member has already lawfully received in a conversation with you. You are solely responsible for your User Content and confirm that you have the rights to it, that it is about you, and that it does not break any law or these Terms.

You are solely responsible for your interactions with other members. Katha is a venue that helps members connect; we do not control and are not responsible for the conduct of any member, online or offline. Verification (Section 8) confirms limited identity information only. We do not run criminal background checks, and we do not screen members for criminal history. Use your own judgement, take reasonable safety precautions, meet in public places, tell someone where you are going, and never send money or share financial information with a member. You can block any member at any time and report anyone who behaves badly; blocking hides you from each other immediately. To the fullest extent permitted by law, you assume all risk arising from your interactions with other members, and you release Katha from claims arising out of those interactions.
Verification is required for every member. It works like this: you upload a selfie, taken in the moment with a hand gesture we ask for, and a government-issued identity document. A member of our staff compares the selfie with your profile photos and the document with the name and date of birth on your profile, and either approves your profile or sends a document back with a note explaining what to fix. We aim to decide within 24 hours. Approved documents are deleted immediately; the handling and retention of these images is described in Section 6 of the Privacy Policy.
We may decline to verify a profile, ask you to verify again, or remove a verified badge at any time. A "verified" badge means our staff found that the document appeared genuine and matched the selfie and profile. It is not a guarantee of a member’s identity, character, intentions, criminal history, or safety, and you should not rely on it as such.
Photos and video introductions are screened automatically for explicit content, and content that fails is rejected. Reports from members are reviewed by our staff, who may look at the reported profile and messages. We may remove content, restrict features, or suspend or close an account, with or without notice, if we reasonably believe you have broken these Terms or put members at risk. An account closed for abuse, and any account that was reported or blocked before it was deleted, cannot be re-registered with the same email address or phone number for 30 days. Closure for a breach of these Terms does not entitle you to a refund. If you think we got it wrong, write to us and a person will review the decision.
The Service, including its design, text, graphics, logos, and software, is owned by Katha or its licensors and is protected by intellectual property laws. We grant you a limited, personal, non-transferable licence to use the Service for its intended purpose. You may not copy, modify, distribute, or create derivative works from the Service without our permission. If you believe content on Katha infringes your copyright, email support@kathamatrimonial.com with the details and we will look into it.
The Service relies on third-party providers, for example for payments, hosting, text messages, and astrology calculations; they are listed in the Privacy Policy. We are not responsible for third-party services, and your use of them may be subject to their own terms.
You may delete your account at any time from the Settings page; your data is then deleted as described in the Privacy Policy. We may suspend or close your account, with or without notice, if you breach these Terms, create risk or legal exposure for us, or for any other lawful reason, and we may keep the limited records the Privacy Policy describes. Sections that by their nature should survive (including Sections 5, 7, 9, and 13 through 18) survive termination.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any information (including compatibility scores) is accurate or reliable. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.
TO THE FULLEST EXTENT PERMITTED BY LAW, KATHA AND ITS OWNERS, OFFICERS, AND STAFF WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE OR YOUR INTERACTIONS WITH OTHER MEMBERS. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) CAD $100.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that the law where you live does not allow us to exclude or limit. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
To the extent permitted by law, you agree to indemnify and hold harmless Katha and its owners, officers, and staff from claims, damages, losses, and expenses (including reasonable legal fees) arising out of your User Content, your interactions with other members, or your breach of these Terms or of any law.
Please read this section carefully; it affects your legal rights. First, we both agree to try to resolve any dispute informally: write to support@kathamatrimonial.com with a description of the problem and what you would like us to do, and allow 30 days for us to resolve it.
If we cannot resolve a dispute informally, then, to the fullest extent permitted by the law where you live, any dispute arising out of or relating to these Terms or the Service will be resolved by final and binding arbitration on an individual basis, and not in a class, collective, or representative proceeding. The arbitration will be administered by the ADR Institute of Canada under its Arbitration Rules, seated in Toronto, Ontario, conducted in English, by video or written submissions where the amount in dispute is under CAD $10,000, and Katha will pay the filing fees for a claim of that size. You and Katha waive the right to a jury trial and the right to participate in a class action, to the extent permitted by law. Either party may bring a qualifying claim in small-claims court instead. You may opt out of this arbitration agreement by emailing us within 30 days of first accepting these Terms; opting out does not affect any other part of these Terms.
This arbitration agreement does not apply where the consumer-protection law of your province, state, or country prohibits it, including for consumers resident in Ontario, Quebec, the United Kingdom, or the European Economic Area. In that case, and for any dispute not subject to arbitration, the courts of Ontario, Canada have jurisdiction, and you consent to that jurisdiction and venue, except that you may also bring a claim in the courts of your own country of residence where the law gives you that right.
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-laws rules. If you are a consumer, you also benefit from any mandatory provisions of the law of the country or province where you live. If any provision is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets, and we will tell you if we do. We are not liable for delays or failures caused by events beyond our reasonable control. These Terms and the Privacy Policy are the entire agreement between you and Katha regarding the Service.
We may update these Terms from time to time. When we make a material change, we will update the "Last updated" date above and email you at least 30 days before it takes effect, where feasible. If you keep using the Service after the change takes effect, you accept the revised Terms; if you do not agree, delete your account before then. Changes to prices follow Section 4.
